Legalwiz has strong IP practice — you may want to keep them for trademarks and patents while moving ongoing compliance to us. Or move everything. Here is how we handle the trademark status preservation, contract handover, and CA-led compliance setup either way.

Kick-off & scope decision
Two options: (A) move ongoing compliance to us, keep Legalwiz for IP; (B) full migration including TM/IP. We confirm on the kick-off call. Most customers (60%) choose option A.
Trademark application status mapping
For each active TM application: we pull the IPIndia status (ipindia.gov.in → Trade Marks → Public Search → Search by Application Number). Stage noted: filed / formality / examination / objection / opposed / advertised / registered. Renewal dates flagged for registered marks.
Contract repository transfer
Legalwiz hosts your contracts (shareholder agreement, employment contracts, vendor MSAs, NDAs) inside their portal. We export each as PDF + DOCX (Legalwiz → Documents → Bulk Download). 20-50 documents for a typical Series-A startup.
TM-M for option B (if moving IP too)
If you chose option B and want us as IP attorney too: we file TM-M (Request for change of attorney) with the Trade Marks Registry. Rs.900 govt fee per mark, takes 7-14 days, original filing date preserved.
Ongoing compliance setup
GST PCT-05 filed if needed for GST authorisation. ROC compliance calendar built around your incorporation date (AOC-4 by 30 Oct, MGT-7 by 29 Nov). DIR-3 KYC reminder for all directors. TDS schedule if applicable.
Handover meeting with Legalwiz IP team (if applicable)
For option A, we set up a brief intro between your Legalwiz IP attorney and our CA. They keep handling IP, we handle compliance. Both parties have your dashboard read access.
Pre-migration checklist
Most items are 60 seconds to find. We start the migration faster if you have these ready.
Legalwiz portal login (or read-only invite)
Where:legalwiz.in → My Account → Team → Invite — choose Read-Only role
Active trademark application numbers (and class)
Where:Legalwiz dashboard → Trademarks — or your filing acknowledgement emails from IP India
Active TM registrations + renewal dates
Where:Legalwiz → Registered Marks; cross-check at ipindia.gov.in (renewal due 10 years from filing, then every 10 years)
Contract files (SHA, employment, vendor MSAs, NDAs)
Where:Legalwiz → Documents Repository → Filter by Category → Download all
Incorporation documents (CoI, MoA, AoA, PAN, TAN, GSTIN)
Where:Legalwiz → My Company → Documents — or original MCA/MCA21 issued PDFs
Last paid Legalwiz invoice (for refund claim, if any)
Where:Legalwiz → Billing → Invoices — download PDF
IP attorney’s name and contact (for option A handover)
Where:Most recent communication on your TM application — signature block or email
Pull IPIndia status for every active TM application; flag examination / objection / opposition deadlines
Export contract repository (PDFs + DOCX) from Legalwiz and ingest into your FilingLab document vault
File TM-M for change of attorney if moving IP work too — vakalatnama (Form 18) included
File GST PCT-05 to authorise FilingLab as your GST practitioner
Build ROC compliance calendar (AOC-4, MGT-7, DIR-3 KYC) anchored to your incorporation date
Coordinate handover meeting with your Legalwiz IP attorney for option A (compliance-only migration)
Your IP rights and TM application dates are preserved — TM-M is procedural, not substantive
Already-executed contracts remain enforceable; only the repository location changes
Your CIN, GSTIN, DIN, DSC all stay with you (none of these are platform-bound)
Legalwiz can continue as your IP attorney under option A; only compliance moves
Gotchas & honest fixes
These are real situations we have hit in past Legalwiz migrations. We name them up front so they do not surprise you.
The gotcha
You have a trademark in opposition — the 4-month counter-statement window is running. Switching attorneys mid-opposition feels risky.
Our fix
TM-M can be filed within the opposition window; original counter-statement deadline is preserved. We file TM-M and the counter-statement (Form TM-O) the same week. Legalwiz cannot block this once vakalatnama is on record.
The gotcha
Legalwiz drafted your shareholders’ agreement (SHA), and copyright on the drafted document arguably sits with them. Will reusing it for an amendment cause issues?
Our fix
Standard industry practice: when you commission a legal document, the work-product is yours under an implied work-for-hire arrangement (S.17 of Copyright Act — commissioned work). For absolute clarity, we draft any amendment as a fresh deed of variation, not as a markup. No copyright dispute risk.
The gotcha
Your Legalwiz IP attorney has personal relationships with examiners at the IP office — you fear losing this informal goodwill.
Our fix
Honest answer: those relationships sometimes matter at hearings. Option A (keep Legalwiz for IP, move compliance) is built exactly for this concern. ~60% of our Legalwiz migrations choose this hybrid. We do not pretend our IP team has the same depth.
The gotcha
Legalwiz filed your FSSAI or Shop & Establishment Act licence. The user-credentials for the state portal are not in your hands.
Our fix
Each state has a self-service portal (e.g. FoSCoS for FSSAI). We reset credentials via the registered business mobile or email. If both are with Legalwiz, we file a written request with the state authority — takes 3-7 days, no fee.
What it costs
Migration is free on annual plans. TM-M govt fees (option B): Rs.900 per mark. Most option A customers (compliance-only) pay zero in government fees. Legalwiz pro-rata refund: typical 30-60 days settlement, usually lands at 80-90% of unused fee.
Frequently asked
Yes — this is option A and our most common Legalwiz migration. You retain Legalwiz for trademarks, copyrights, patents, and contract drafting. We handle GST, TDS, ROC, payroll, and notices.
Legalwiz’s policy is pro-rata refund on unused months minus an admin fee (typically 10-15%). Refunds usually settle within 30-60 days. We help with the written request and follow-up cadence.
No. TM-M is purely a change of authorised representative. The application’s legal timeline — filing date, priority, examination, opposition window — is unaffected.
Yes. Commissioned legal drafts vest with the client under copyright work-for-hire principles (S.17 Copyright Act). You can use, amend, and reissue them freely. If amending, we draft a deed of variation rather than markup to keep the chain clean.
No. The licence is in your business’s name. We take over renewal tracking and file the renewal application when due. Login credentials for the state portal are re-established via the registered business mobile or email.
Patent prosecution requires a patent agent registered with the Indian Patent Office. We do not have an in-house patent agent. Honest answer: option A (keep Legalwiz for patents, move compliance to us) is the right choice if patents are central to your business.
